Update #112 on police enforcement of injunction order in Fairy Creek Watershed

Police enforcement of the injunction order in the Fairy Creek Watershed area continued today, on October 20, 2021, with ongoing efforts to keep the Granite Mainline Forest Service Road and other corridors free from any obstructions, devices and open for industry access.

Officers conducted patrols of the corridor and no obstructions were found, no contemnors were found in locking devices or tripods and no one blocking road access.

At approximately 2 p.m., officers established a static road check along the Pacific Marine Forest Service Road, 4 kms from Granite Mainline Forest Service Road. A driver was stopped for having burnt out headlights and was issued a violation ticket. He was advised he was free to leave, but instead parked his vehicle infront of the police vehicles conducting the road check. He was confrontational and attempted to interfere with another vehicle that was stopped, making physical contact with an officer. He was subsequently arrested for assaulting a police officer, and conditionally released with a future court date.

Lake Cowichan RCMP Detachment also received a report of a missing man, 61-year-old Gerald Kearny, who was last seen on October 13 at approximately 10 a.m. in the Fairy Creek Watershed area. A news release has been issued seeking public assistance in locating him.

Active patrols will continue throughout the night to ensure the roads remain clear of obstructions. The public should also expect to encounter road checks, static or roving, within the corridor, where officers will be checking for motor vehicle infractions such as impaired and distracted driving, excessive speed, and use of winter tires.

Additional news release updates will be issued should there be police enforcement resulting in arrests.

Since enforcement began, the RCMP have arrested 1129 individuals; 110 of whom were previously arrested with a combined total of 261 times. Of the total arrested, 871 were for breaching the injunction (contempt of court), 217 were for obstruction, 21 were for mischief, 10 were for breaching their release conditions, 7 were for assaulting a police officer, 1 for counselling to resist arrest, 1 for causing a disturbance, and 1 Immigration Act.
