Update #114 on police enforcement of injunction order in Fairy Creek Watershed

B.C., Lake Cowichan

2021-10-26 18:50 PDT

Police enforcement of the injunction order in the Fairy Creek Watershed area continued today, on October 26, 2021, with ongoing efforts to keep the Granite Mainline Forest Service Road and other corridors free from any obstructions, devices and open for industry access.

Earlier in the morning, officers began working on removing a vehicle that was blocking the main access to Granite Mainline Forest Service Road. Two individuals inside the vehicle refused to leave. Two other individuals were on a wood pallet next to the vehicle, each with one arm secured in a locking device attached to a large black barrel.

By mid-day, the individuals in the vehicle and on the wood pallet were removed and arrested for breaching the injunction (contempt of court). The vehicle was moved aside and the road was re-opened in both directions.

Numerous other vehicles were found parked within 50 meters of the entrance to the Granite Mainline Forest Service Road, in violation of the injunction. By the afternoon, all vehicles had been moved, either voluntarily by owners or towed away by a Teal-Cedar Products contractor.

During the course of the day, a total of 11 individuals were arrested; 8 of whom for breaching the injunction (contempt of court), 2 for obstruction and 1 for assaulting a police officer. The individual arrested for assaulting a police officer had flung a mug with hot liquid content towards officers, hitting one officer in the leg.

Nine of the total arrested were conditionally released in Port Renfrew, and the other two were released without being processed.

Lake Cowichan RCMP Detachment also continues to seek public assistance in locating 61-year-old Gerald Kearny. See news release issued on October 21, with Gerald’s photo and description.

Active patrols will be ongoing, as well as the road checks in the area.

Since enforcement began, the RCMP have arrested 1142 individuals; 110 of whom were previously arrested with a combined total of 261 times. Of the total arrested, 881 were for breaching the injunction (contempt of court), 219 were for obstruction, 21 were for mischief, 10 were for breaching their release conditions, 8 were for assaulting a police officer, 1 for counselling to resist arrest, 1 for causing a disturbance, and 1 Immigration Act.
